Are Texas Energy Consumers Being Fooled With "FREE OFFERS?"
Retail Energy Providers (REP) in Texas are misleading consumers by advertising "FREE NIGHTS, FREE WEEKENDS, FREE MONTHS, and more" in order to entice consumers under the guise of SAVING MONEY on their electric bills. But when a consumer gets "FREE NIGHTS" but at the same time the Electric Company increases the customers rate for DAYS by two times, three times, or even more … what's really free? When a REP advertises rates on several plans, then a consumer calls and says they have a lower quote from another company and then the REP comes up with ANOTHER RATE PLAN that is only used to defeat the competition when the consumer is smart enough to "check around" … that hurts competition, which was supposed to be one of the main reasons for "Deregulation."
Here is a perfect example. When comparing Energy Plans, all that "varies" is the "ENERGY CHARGE." The rules require that companies make available to consumers an Electricity Fact Label (EFL). How many people know this or actually see an EFL? Very few.
Here we have an EFL for TXU's "FREE NIGHTS & SOLAR DAYS" plan which charges 15.8 cents per kWh all the time but "0" from 9PM through 5.59AM. Next, we have TXU's 12 Month Plan, with no "FREE" energy, but the charge is 8.8 cents for 0-1200 kWh, 4.4 cents for 1201-2000 kWh, and 9.2 cents for 2000 kWh or more.
Why does TXU increase their rate per kWh for daytime use on the "FREE NIGHTS PLAN" if the nights are really FREE? Isn't this pretty deceptive? Contact the Texas Attorney General here.

Where is the Public Utility Commission and the Texas Attorney General on these issues? The solution is actually quite simple:
(1) Eliminate all offers of "Free" Energy;
(2) Allow only plans based on the "Length of the Contract and Guaranteed Rate Period;"
(3) Require each company to provide their offer "for all of their plans" to all potential customers.
The Public Utility Commission of Texas should work with the "Consumer Protection" Division of the Texas Attorney General's Office. This has become, not about the Free Market, but about "Freedom to Deceive."
